Terms of Service

1. Agreement to Terms

By accessing or using hullscore.com and the HullScore vessel intelligence platform (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). The Service is operated by MarineIO LLC, a limited liability company (“MarineIO LLC,” “we,” “us,” or “our”). HullScore is a brand name of MarineIO LLC. If you do not agree to these Terms, do not use the Service. These Terms apply to all users, visitors, and others who access or use the Service.

2. Description of Service

HullScore, operated by MarineIO LLC, is a boat history report platform that generates reports (“Reports”) about recreational watercraft based on listing URLs, Hull Identification Numbers (HINs), and other user-supplied inputs. Reports are assembled from a combination of publicly available government databases, third-party vessel history databases, marketplace data, large language model (LLM) inference, and proprietary data pipelines. Report content includes, but is not limited to, stolen vessel screening, maritime lien searches, salvage and auction record checks, federal accident history, manufacturer recall data, vessel documentation status, market pricing analysis, and AI-generated assessments.

3. AI-Generated Content: Critical Limitations

HullScore Reports are generated by artificial intelligence and are not statements of fact. Large language models (LLMs) are probabilistic systems that synthesize patterns across training data. They can and do produce outputs that are plausible-sounding but factually incorrect, incomplete, outdated, or entirely fabricated (“hallucinations”). No AI-generated assessment should be treated as ground truth.

Specifically, you acknowledge and agree that:

  • Price intelligence is estimated, not guaranteed. Market comparables and valuation ranges are derived from historical listing data and algorithmic inference. Actual transaction prices may differ materially. HullScore is not an appraiser, broker, or licensed valuation service.
  • Fleet accident data is a subset, not a census. Our accident rate calculations are derived from the USCG Boating Accident Report Database (BARD), which represents accident-linked vessels reported to the USCG between 2009 and 2023. This dataset does not represent the full U.S. recreational boating fleet of approximately 11.6 million registered vessels. Absence of data does not mean absence of accidents.
  • Recall data may be incomplete or delayed. Recall information is sourced from publicly available government databases and may not reflect the most current recall status of a specific vessel.
  • Title and theft screening is informational, not conclusive. Our Reports include stolen vessel, maritime lien, and salvage/auction record checks sourced from third-party databases. These databases aggregate records from law enforcement agencies, insurance companies, the USCG, and auction houses, but they are not exhaustive. A “clear” result does not guarantee clear title, absence of liens, or that the vessel was never stolen or salvaged. Maritime liens can arise by operation of law without any public recording. Always obtain a professional title search and/or USCG Abstract of Title before closing a transaction.
  • Photo analysis is AI inference. Our computer vision assessments of vessel photos are probabilistic estimates of condition and are not a substitute for physical inspection by a qualified marine surveyor.
  • Equipment and condition assessments are inferred from listing data. We do not physically inspect vessels. Equipment items listed as “confirmed” are confirmed only within the context of the listing text and imagery, not by independent verification.

4. Not a Substitute for Professional Inspection

A HullScore Report is not a marine survey and must not be used as one. Before purchasing any vessel, you should engage a qualified, independent, SAMS- or NAMS-certified marine surveyor to conduct a full out-of-water condition and valuation survey. HullScore Reports are intended as a preliminary screening tool only, not as a final determination of a vessel's condition, value, or suitability for any purpose.

HullScore is not responsible for any purchase, financing, insurance, or other decision made in reliance on a Report. Any vessel transaction carries inherent risk that no automated tool can fully assess.

5. No Financial, Legal, or Insurance Advice

Nothing in any HullScore Report or on this website constitutes financial advice, investment advice, legal advice, insurance advice, or any other professional advisory service. HullScore is a data intelligence product. Negotiation suggestions, offer strategies, and “fair value” anchors are analytical outputs generated by AI models and do not constitute a professional opinion or recommendation. Consult qualified professionals before making purchase or financial decisions.

6. Data Accuracy and Timeliness

Data sources used to generate Reports include, but are not limited to: stolen vessel registries, maritime lien filings, salvage and auction records, USCG BARD accident records, USCG recall databases, USCG vessel documentation records, marine casualty and pollution records, marketplace listing data, and industry valuation data. All data has an effective date and may be stale, incomplete, or inaccurate. HullScore makes no representation that any data is current, accurate, or complete as of the date you view a Report.

Reports are generated based on data available at time of generation. A Report generated today may differ materially from one generated tomorrow on the same listing.

7. Payment and Refund Policy

Access to premium Report content requires a one-time payment processed by Stripe. Because Reports are generated immediately upon payment confirmation, refund eligibility is limited. If our systems fail to deliver a Report after payment (pipeline failure, data source outage), we will automatically issue a full refund. If a Report is delivered but contains materially fewer analysis sections than expected due to data availability for your vessel, contact support@hullscore.com within 7 days for a case-by-case review. We do not offer refunds based solely on dissatisfaction with AI-generated analysis or the outcome of data lookups that returned negative (clean) results.

Report access window. Report URLs remain accessible via web browser for thirty (30) days from the date of generation. After this period, the link will expire and the Report will no longer be viewable online. The underlying Report data is retained by MarineIO LLC indefinitely and is not deleted upon link expiration. We recommend saving or bookmarking your Report URL promptly after delivery.

8. Disclaimer of Warranties

THE SERVICE AND ALL REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MARINEIO LLC (D/B/A HULLSCORE) EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY DATA, ANALYSIS, VALUATION, OR OTHER OUTPUT PRODUCED BY THE SERVICE IS ACCURATE, RELIABLE, OR SUITABLE FOR ANY PURPOSE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MARINEIO LLC (D/B/A HULLSCORE), ITS MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR DATA PROVIDERS BE LIABLE FOR ANY:

  • DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
  • LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL;
  • COSTS OF SUBSTITUTE GOODS OR SERVICES;
  • DAMAGES ARISING FROM A VESSEL PURCHASE, FINANCING DECISION, OR INSURANCE CLAIM MADE IN RELIANCE ON A REPORT;
  • DAMAGES ARISING FROM INACCURATE, INCOMPLETE, OUTDATED, OR AI-HALLUCINATED REPORT CONTENT;
  • ANY OTHER LOSS OR DAMAGE OF ANY KIND, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.

THIS LIMITATION APPLIES WHETHER OR NOT HULLSCORE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

IN ALL CASES, MARINEIO LLC'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO MARINEIO LLC IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless MarineIO LLC (d/b/a HullScore) and its members, managers, officers, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any vessel purchase or financial decision you make based on Report content.

11. Intellectual Property

The Service, including its software, design, branding, and Report format, is owned by MarineIO LLC and protected by intellectual property laws. Reports generated for you are licensed for your personal, non-commercial use only. You may not resell, redistribute, or republish Report content without express written permission.

12. Third-Party Data and Services

Reports incorporate data from third-party sources including vessel history database providers, the U.S. Coast Guard, USCG National Vessel Documentation Center, online marketplace platforms, and others. HullScore does not control these sources and makes no representations regarding their accuracy, completeness, or timeliness. Stolen vessel, lien, and salvage records are provided for informational purposes only and must be verified with the respective agencies. Third-party trademarks, vessel names, and make/model references are property of their respective owners.

13. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations;
  • Scrape, crawl, or systematically download Report content;
  • Resell or commercially exploit Report content without authorization;
  • Attempt to reverse-engineer our models, pipelines, or data sources;
  • Submit false or misleading vessel data to manipulate Report outputs.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively through binding individual arbitration under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You waive the right to participate in class action litigation or class-wide arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
